These Terms of Service ("Terms") govern your access to and use of bettershell.ai (the "Service"), an AI-powered resume tailoring web application operated by Spencer Seay, an individual, doing business as bettershell.ai ("bettershell.ai," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
bettershell.ai lets you build a profile containing information such as your work history, education, skills, and contact information, and to generate a tailored, one-page resume in PDF format for a specific job posting using artificial intelligence. To generate a resume, you paste in a job posting link or description, and the Service uses that information together with your profile to produce tailored resume content.
You must be at least 13 years old to use the Service. If you are between 13 and 17 years old, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that any information you provide to us is accurate and up to date.
To use most features of the Service, you must create an account using either an email address and password or your Google account (via Google OAuth), processed through our authentication provider, Supabase. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@bettershell.ai if you suspect any unauthorized use of your account.
Every new account receives 3 free lifetime resume generations. After you use your free generations, you may purchase additional generations in the form of one-time credit packs through Stripe Checkout. One (1) credit equals one (1) successful resume generation. If a generation attempt fails due to a technical error on our end, you will not be charged a credit for that attempt.
Credit packs are one-time purchases — bettershell.ai does not currently offer subscriptions or any form of automatically recurring billing. Credits do not expire and remain available on your account indefinitely. Credits are non-transferable: they may only be used by the account that purchased them and cannot be transferred, gifted, sold, or combined across accounts.
Refunds for credit pack purchases are governed by our separate Refund Policy, which is incorporated into these Terms by reference.
Resume content generated by the Service is created using artificial intelligence to help you draft and tailor your resume — it is not professional career, legal, or employment advice. AI-generated content can be incomplete, inaccurate, or contain errors, including incorrect dates, mischaracterized experience, or other mistakes. You are solely responsible for reviewing, editing, and verifying the accuracy of any resume content before submitting it to an employer or using it for any other purpose. bettershell.ai does not guarantee that using the Service will result in interviews, job offers, or any particular employment outcome.
When using the Service, you agree not to:
We may investigate and take appropriate action, including suspending or terminating your account, if we reasonably believe you have violated this section.
You may stop using the Service and delete your account at any time by contacting us at support@bettershell.ai. We may suspend or terminate your account if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior (including payment fraud or chargebacks), or if required to do so by law. Upon termination for cause, any unused credits on your account are forfeited and are not refundable, in addition to the terms described in our Refund Policy. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.
Your content. As between you and bettershell.ai, you retain all ownership rights in the profile information, resume content, and any other content you input into the Service, as well as the resumes generated for you. You grant us a limited, non-exclusive, worldwide, royalty-free license to access, store, reproduce, and process this content solely as necessary to operate and provide the Service to you — including transmitting relevant content to our third-party AI providers as described in our Privacy Policy. This license ends when you delete the relevant content or your account, except to the extent copies persist for a limited time in routine backups or as otherwise described in our Privacy Policy.
Our content. The Service itself — including its software, design, text, graphics, and underlying technology (excluding content you submit and the resumes generated specifically for you) — is owned by bettershell.ai or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Service for your personal, non-commercial job-search purposes, subject to these Terms.
The Service relies on third-party providers to operate, including Supabase (account and data storage), Anthropic and OpenAI (AI-powered resume generation), and Stripe (payment processing). Our Privacy Policy describes these relationships and what data is shared with each provider in more detail. We are not responsible for the independent acts or omissions of these third-party providers.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES. YOU USE THE SERVICE AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, BETTERSHELL.CV AND SPENCER SEAY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EMPLOYMENT OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless bettershell.ai and Spencer Seay from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your misuse of the Service.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts. Before filing a claim, we encourage you to contact us at support@bettershell.ai so we can try to resolve the issue informally first.
We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you (such as by email or an in-app notice). Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and bettershell.ai regarding the Service.
